Changes to Job Ads!

In a constant effort to promote fairness and uphold the rights of employees, significant changes to job ads came into effect on 7 January 2023. These changes aim to prevent job ads from including pay rates that undercut employees' minimum entitlements, ensuring a level playing field for all job seekers.

Additionally, employers advertising pieceworker positions must specify or state the applicable periodic pay rate.

What has changed?

As of 7 January 2023, job ads must adhere to the following guidelines:

  • No Undercutting Minimum Entitlements: Job ads can no longer include pay rates that would breach the Fair Work Act or any fair work instrument, such as an award or enterprise agreement. This ensures that job seekers are not misled by offers that fall short of the minimum wages they are entitled to.

  • Specifics for Pieceworker Positions: Employers advertising pieceworker positions, where employees are entitled to a periodic rate of pay (e.g., hourly or weekly rate), must specify the applicable periodic pay rate in the job ad. Alternatively, they can state that a periodic pay rate will apply.

 

Next steps for employers

  • Review all live and future job ads to ensure they do not contain pay rates that could potentially undercut minimum entitlements.

  • Update Pieceworker Advertisements.
