Changes to Zombie Agreements

On 7 December 2023, a significant change is set to occur – the termination or 'sunset' of certain agreements made before 2010 that are still lurking in the shadows, aptly named 'zombie agreements.' But fear not, because there's a lifeline: you can apply to the Fair Work Commission before this date to extend their operation. 

What is a zombie agreement?

A 'Zombie Agreement' is an agreement that was made before 1 January 2010, and is still running today. Some types of these agreements were created before 2010 and kept going even after the Fair Work Act 2009 came into full effect on 1 January, 2010.
